Lambeth Planning Notification dated 21st February 2018, and relating to planning application 17-05806-VOC, dated 29th November 2017 refers to an application by Mitchells & Butlers to permanently extend the hours of operation of the All Bar One venue on the ground floor of County Hall appartments at 1-3 Chicheley Street London SE1 7PY.

More Details & Background
Original Application for Change of Use
In 1998, when County Hall was first being redeveloped, 1-3 Chicheley Street (the current location of All Bar One) was granted planning permission for change of usage from it’s original purpose as a high street bank, to a bar/restaurant under planning application 98_00177_FUL. This allows hours of operation granted under Condition 4 of that application, as follows:
“The use hereby permitted shall not operate otherwise between the hours of 11 am-1130pm daily Mondays to Saturdays (inclusive) and 12am-10.30pm on Sundays and Bank or National Holidays”.
2015 Application for Extension to Hours of Operation
On 21st January 2015, Mitchells & Butlers submitted Planning Application 15/00320/VOC to Lambeth Council requesting, amongst other things, an extension to their hours of operation.
This application was granted on 13th July 2015 by Lambeth Council on the strict condition that the extended hours of operation were discontinued and the opening hours returned to those consented under the original planning application (98/00177/FUL) on or before 12 months from the date of the decision notice (i.e. no later than 12th July 2016).
The reason cited by Lambeth Council for the temporary nature of the permissions was to allow the council to review the extended hours and ensure that the:
“on-going residential amenity of neighbouring occupiers is protected“.
The extended hours of operation granted under Condition 4 of this decision notice were such that:
“use hereby permitted shall not operate otherwise between the hours of 8am -11pm Monday to Thursday, 8am – midnight Friday, 9am – midnight Saturday and 9am -10.30pm Sundays”.
The Current Application
The current application seeks to remove Condition 1 of the 2015 decision (i.e. the temporary nature of the permissions granted, such that they become permanent).
In addition, it seeks to modify Condition 4 of the application, which stipulates the hours of operation.
The hours of operation being requested under the new application are somewhat ambiguous. The covering letter submitted to Lambeth by the agents acting on behalf of Mitchells & Butlers is explicitly requesting the following hours of operation:
Allow operations until 2am on New Year’s Eve
…although, the Lambeth Planning Portal refers to the following as the proposed new wording of Condition 4 (hours of operation):
9am to 11.30pm Mondays to Saturdays
9am to 10.30pm Sundays and Bank Holidays.
